Participant Waiver & Release

1. Who this agreement protects

In this agreement, the “Released Parties” are: (a) Velastegui Services LLC d/b/a Frontline Hydration; (b) Trust In Taylor LLC; (c) each of their owners, members, managers, officers, employees, volunteers and agents, including Gabe Velastegui and Hakim Taylor individually; (d) the class instructors, contractors and community partners working the event; and (e) the owners, operators and landlords of Riptide Golf & Rec and the property where the event is held.

2. Activities and their risks

The event may include yoga, Pilates, strength and circuit training, fitness challenges (including a pull-up rig or similar equipment), stretching and mobility work, recovery and wellness demonstrations, vendor booths, food and beverages from independent vendors, music, and use of the venue’s turf, simulator and common areas (together, the “Activities”).

I understand the Activities carry inherent risks that cannot be fully removed, even when everyone is careful. These include muscle strains, sprains, fractures and joint injuries; overexertion, dehydration and heat illness; heart attack, stroke or other medical events; slips, trips and falls; contact with other people or equipment; equipment failure; allergic reactions or foodborne illness; and, in rare cases, serious injury, paralysis or death.

3. My health and my choices

I confirm I am physically able to take part in the Activities I choose. If I have a heart condition, high blood pressure, a recent injury or surgery, am pregnant, or have any condition that exercise could affect, I have talked with a doctor or accept the risk of not doing so. I choose my own level of effort, I may modify or skip any movement, and I will stop if I feel pain, dizziness or shortness of breath. Instructors are not giving me medical advice.

4. Assumption of risk

I am attending voluntarily. I knowingly and freely assume all risks, both known and unknown, of attending and participating, even if those risks arise from the negligence of the Released Parties or others.

5. Release and waiver of liability

TO THE FULLEST EXTENT ALLOWED BY FLORIDA LAW, I RELEASE, WAIVE, DISCHARGE AND PROMISE NOT TO SUE THE RELEASED PARTIES FOR ANY AND ALL CLAIMS, DEMANDS, LOSSES OR DAMAGES, INCLUDING FOR PERSONAL INJURY, DEATH OR PROPERTY DAMAGE, ARISING OUT OF OR RELATED TO MY ATTENDANCE AT OR PARTICIPATION IN THE EVENT, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF ANY RELEASED PARTY.

This release does not apply to gross negligence or intentional misconduct, or to anything Florida law does not allow to be waived.

6. Indemnity

I agree to defend, indemnify and hold harmless the Released Parties from any claims, costs and reasonable attorney’s fees arising from my own conduct at the event, or from any claim brought by someone else on my behalf, to the extent allowed by law.

7. Vendors and professional services

Vendors at the event are independent businesses responsible for their own products and services. Any IV therapy, injection, massage, cold plunge, cryotherapy or other hands-on or medical service (including services offered by Frontline Hydration) requires the provider’s own health screening and consent form. That separate consent is in addition to this agreement, not a replacement for it.

8. Medical emergencies

If I am injured or become ill, I authorize the Released Parties to call emergency services and to arrange first aid or transport they believe is needed. I am responsible for any resulting medical costs. The Released Parties are not required to provide medical care.

9. Rules, conduct and property

I will follow instructor, staff and venue rules and posted signs. The organizers may limit or end my participation, or ask me to leave, for safety reasons. The Released Parties are not responsible for lost, stolen or damaged personal property.

10. Photos and video

Photos and video will be taken at the event for Frontline Hydration and Trust In Taylor marketing and social media. My choice below controls how my image may be used, and I can change it later by emailing contact.frontlinemotion@gmail.com. Neither organizer will share my health information in any post.

11. General terms

Florida law governs this agreement, and any dispute will be heard in Martin County, Florida. If any part is found unenforceable, the rest stays in effect, and the release will be enforced to the greatest extent permitted. This agreement covers the event above and any rescheduled date. My typed or electronic signature has the same effect as a handwritten one.

12. Minors (parent or guardian)

If I am signing for a minor, I am the minor’s parent or legal guardian. I agree to all terms above on the minor’s behalf and my own, I will supervise the minor at all times, and I understand instructors may limit a minor’s participation. On the minor’s behalf, I waive, to the extent permitted by section 744.301(3), Florida Statutes, the minor’s right to sue for injury, including death, or property damage resulting from the inherent risks of the Activities.
